Toy's R Us Get's Pushed Over

Ok, so I was reading the online version of The Arizona Republic this morning and I am already pissed about the lack of local coverage about anything I care about. Scottsdale, AZ should have it's own paper.

Jesus Christ Almighty!!! I am sick to death about how this or that is affecting Scottsdale. I guess all the advertising revenue comes from there, because here in Surprise, Peoria, Glendale, Buckeye, Goodyear and the rest of the west valley, we must have nothing to offer...

Sorry about that, I will save it for another time.

Today what I am really pissed about is the unequal enforcement of this country's laws. Now maybe "no one" got hurt, killed, lost property or anything... except our laws were broken in several ways (and for the wrong reasons,) and no one is going to jail!!!

Okay here is the story:

NEW YORK - Toys "R" Us Inc. agreed on Saturday to award a Chinese-American infant a $25,000 prize in a New Year's baby contest, a reversal after the company came under fire for disqualifying the girl because her mother was not a legal U.S. resident.

Chinese-American advocates said they were infuriated by Toys "R" Us, which opened its first mainland China store less than a month ago, and launched an e-mail campaign on the issue.

The company responded by awarding each of the three babies in the grand prize pool of the "First Baby of the Year Sweepstakes" a $25,000 savings bond. Toys "R" Us is the parent company of Babies "R" Us, which sponsored the contest.

"We love all babies," the company said in a statement. "Our sweepstakes was intended to welcome the first baby of 2007 and prepare for its future. We deeply regret that this sweepstakes became a point of controversy."

Yuki Lin was born at the stroke of midnight at New York Downtown Hospital, according to hospital officials. The Wayne, N.J.-based company had said the prize would go to the first American baby born in 2007.

Although promotional materials called for "all expectant New Year's mothers" to apply, Toys "R" Us spokeswoman Kathleen Waugh said eligibility rules required babies' mothers to be legal residents. Many sweepstakes have such requirements, Waugh said.

Waugh said the prize instead was awarded to the runner-up, after the contest administrator was told that Yuki's mother "was not a legal resident of the United States." The runner-up was Jayden Swain, born 19 seconds after midnight at Northeast Georgia Medical Center in Gainesville, Ga.

The third baby in the running was born in Bay Shore, N.Y., to a couple from El Salvador.

Some Chinese-American advocates said the company's decision smacked of second-class citizenship.

Albert Wang, an attorney, who launched the e-mail campaign said "She was deprived of $25,000 intended to be used for her college education because of who her parents are," he said.

The company hopes the matter is settled now.

OK, so as most people who know me will say, I don't give a diddly damn where you are from or the color of your skin but if you are here Illegally you should be deported immediately just like in every other country on Earth.

So here we are in a country that prides itself on legal fairness and due process and it is all so much lip service.

What do you suppose would happen if I snuck into China and tried to TAKE something I was not legally entitled to. Ok, now substitute China with the name of any other country in the world. TAA DAA!!! Deportation!!!

Ok let's get back to the story - where are all the FACTS so that a well educated person can judge for him/herself what the hell is happening here. Item 1: where is the father? Item 2: how did she come to be here in a non-legal status? Item 3: why is she not at any point in this story called a criminal? 4: why does Attorney Wang assume, this new born child of an illegal alien, will be going to college on the shirt tails of an illeagal act. (By definition that would be conspiricy to commit fraud.) 5: why does the newspaper feel the need to note that "The third baby in the running was born in Bay Shore, N.Y., to a couple from El Salvador." without documenting their legal status? They opened the door to the question of THEIR legal status, so how about telling us??

What has me all pissed off is the way "Chinese-American advocates" or "Mexican-American advocates" or "Who-the-fuck-ever-American advocates" get to play the "race card", with no regard for a society that is supposedly color blind, when ever it strictly benefits them and them alone. Racists, be they black, white, yellow, brown, orange with purple polka dots are all gigantic morons and idiots because they can not close their eyes and see...   Last time I checked, the measure of a man or woman is how they behave in life, not the way they dress, the language they speak or the style of house they live in. By filling out the entry a PERSON LIED - not a Chinese PERSON , just a PERSON . That PERSON should be disqualified. Period.

Look at it this way: The contest entry form is a contract. Period. OK? 3 parts to a contract.

a) the offer - If you mow my lawn every week, I will pay you $5 per week

b) acceptance -  I agree to mow your lawn for $5 per week

c) consideration - the "this for that" section. $5 changes hands every week in exchange for the lawn being mowed.

If either of the 2 parties break the agreement without mutual consent and/or without a time specific time frame to cease work, they are in breech of contract and can therefore walk away or sue to have the contract enforced. Simple stuff really.

HOWEVER!!! According to every state in the Union as well as under Federal law, no contract to do ANYTHING ILLEGAL is binding on either party. So if Sam agrees in writing to give Lou poison because Lou's wife will pay him 10 dollars, this is not a legal contract. If Sam takes the money and runs, nothing anyone can do to recover the money or carry out the terms of the contract because it is not enforceable.

So in the case of the Chinese Illegal Alien:

First off we have a newspaper report that only serves to inflame a situation. There is not enough background here for ANYONE to make any true sense out of the situation without more information.

She is here illegally ( "not a LEGAL RESIDENT" as quoted in the article. This could have been stated as illegal immigrant but that is not politically correct anymore, now is it?? Nor does it apply to anyone other than Latinos by all the press we look at now. Those other than Latinos are described as "entering the country illegally" if described as anything other than "immigrants" at all)

She illegally entered a contest. By entering this contest she commited perjury (this being a legal contract between her and Toys R Us). By submitting the entry form she did in fact submit a contract with false or misleading information. That is again reason enough for every court in the land to have the contract voided. She in fact lied saying she met all contractual requirements.

After the birth was she taken into custody? She was publicized as being here illegally. If I go into a bar with my concealed handgun (for which I have a permit to carry concealed), rob a liquor store or even set off fireworks, I get a free ride to jail as soon as I get caught - not a $25,000 Savings Bond...

Was her daughter removed from the parent's custody due to her parents commiting criminal acts? As an American Citizen she needs to be protected from criminals!! (Her mother, again, is here illegally making her worth putting in the slammer and then shipping her back to where she came from... And BTW charge the moron for the ticket out, too!!!)

OR

Did a huge American company just, once again, cave in to a group of idiots playing the "Race Card" instead of standing tall and telling folks "NO!! It is NOT ok to break the law just because someone else is doing so to get ahead... We will not curry favor with anyone or any group by condoning their breaking the laws of this country!! We will only conduct our business in a fair and LEGAL way."

I am totally insane and have not a leg to stand on because doing things the legal way is now only an option. As long as a lawyer cows a company to cave in by threatening an E-Mail campaign by a bunch of illegal imigrants and so-called "whatever-americans", contracts are now not worth the paper they are written on.

 

For this we can thank all our hand-ringing-carreer-politicians...and their hand picked cronies the State and Federal judiciary who rewrite the laws as they see fit, knowing they do not have to answer to them.

I have a great idea!!! Deport all the politicos and their lackeys ( the lobbiests and judges) and start over !!!!
